Enterprise & SDK Terms

These terms apply on top of the general Terms of Service for SDK, Enterprise, and Brand customers. Personal-data processing is governed by the DPA.

1. Scope

These Enterprise & SDK Terms supplement the Terms of Service and apply to customers using the RoLearn Multiplatform SDK and/or an Enterprise or Brand workspace. Where they conflict with the general Terms, these Enterprise & SDK Terms control for the relevant services. Processing of personal data on the customer's behalf is governed by the Data Processing Agreement.

2. Customer Data Ownership

As between the parties, the customer owns the telemetry and other data it submits ("Customer Data"). The customer grants RoLearn a limited license to host, process, and analyze Customer Data to provide the Service and, in aggregated and de-identified form, to improve RoLearn’s models and benchmarks. RoLearn will not disclose a customer’s identifiable Customer Data to other customers.

3. Customer Responsibilities & Warranties

  • The customer is the controller of player data it sends and is responsible for its lawful basis, notices, and consents — including parental consent for minors where required.
  • The customer will not send direct identifiers (email, phone, government IDs, payment card numbers) through the SDK.
  • The customer will comply with the terms and policies of any platform on which its game runs (e.g. Roblox), including their data and children's-privacy rules.
  • The customer is responsible for securing its API keys and for usage under them.

4. Security & Availability

RoLearn maintains the technical and organizational measures described in the DPA. RoLearn targets high availability for ingest and dashboards but, unless a separate written SLA is agreed, the Service is provided on a commercially reasonable-efforts basis without a guaranteed uptime commitment.

5. Quotas, Plans & Fees

SDK plans carry monthly event quotas and feature entitlements as described at purchase. Exceeding quota may result in throttling or overage handling as configured for the plan. Fees, billing interval, and any committed volumes are set out in the applicable order or plan selection.

6. Data Export & Retention

Where the plan includes data export, RoLearn delivers encrypted exports to the customer-configured destination. Telemetry retention follows the windows in the Privacy Policy (default 30 days for SDK events) unless a different retention is agreed in writing.

7. Confidentiality

Each party will protect the other’s confidential information with at least the same care it uses for its own, and use it only to perform under the agreement. This does not apply to information that is public, independently developed, or rightfully obtained from a third party.

8. Term, Suspension & Termination

RoLearn may suspend SDK ingest or workspace access for non-payment, material breach, security risk, or where required by law. On termination, data handling follows Section 9 of the DPA (return/deletion). Accrued fees remain payable.

9. Liability

The limitation of liability in Section 11 of the Terms of Service applies to these Enterprise & SDK Terms. For negotiated Enterprise agreements, a separate liability cap may be set out in the order form.
